4:50pm: The European Union urged Libyan authorities on Saturday to ensure the captured son of Muammar Gaddafi is brought to justice in full cooperation with the International Criminal Court. Saif al-Islam, once tipped to succeed his late father as Libyan leader, has been arrested by fighters in the southern Libyan desert.
“The Libyan authorities should now ensure that Saif al-Islam is brought to justice in accordance with the principles of due process and in full cooperation with the International Criminal Court,” said Michael Mann, a spokesman for the EU’s foreign policy chief Catherine Ashton
4:40pm: A spokesman for Libya’s outgoing interim government said on Saturday that Saif al-Islam Gaddafi would be tried in the country rather than being sent to The Hague.
“This is the final chapter of the Libyan drama,” Information Minister Mahmoud Shammam told Reuters. “We will put him on trial in Libya and he will be judged by Libyan law for his crimes.”
Gaddafi, like his late father, was indicted for crimes against humanity by the International Criminal Court (ICC) at The Hague over his alleged role in killing demonstrators after the anti-Gaddafi uprising began in February. But Libyans also want to try him for previous alleged crimes. Shammam said former intelligence chief Abdullah al-Senussi, the remaining Libyan indicted by the ICC who is still on the run, would be found in time. “We will hunt him until we capture him or kill him,” he said.
4:39pm: The prosecutor of the International Criminal Court says he will travel to Libya next week for talks with the country’s transitional government on where Moammar Gadhafi’s son Seif al-Islam will be tried.
Prosecutor Luis Moreno Ocampo says that while national governments have the right to try their own citizens for war crimes, he is concerned that Gadhafi will have a fair trial and that he be tried for the same charges he faces at the ICC.
4:34pm: An ICC spokesman, Fadi el-Abdallah, told the BBC that Libya had a legal obligation to hand over Saif al-Islam – who is wanted on charges of crimes against humanity – to the court.
However Mr Abdallah added that the final decision on where any trial would take place was up to the ICC judges after consultations with the Libyan authorities.
4:22pm: A man who appeared to be Saif al-Islam Gaddafi, but who refused to confirm his identity, was flown by Libyan militiamen to the town of Zintan on Saturday from the desert where he was captured, a Reuters correspondent who was on the plane said.
The man, who fighters said was the late Muammar Gaddafi’s son and heir apparent, wore traditional robes with a scarf pulled over his face, but those featuresvisible despite a heavy black beard, as well as his rimless spectacles, conformed to pictures of the 39-year-old younger Gaddafi.
The man’s thumb, index finger and another finger were heavily bandaged.
A crowd of hundreds thronged the runway in Zintan, preventing his captors removing the prisoner and his four male companions arrested with him overnight near the town of Obari. Some people tried to board the plane but were held back by the fighters, who come from Zintan.
3:25pm: The International Criminal Court Prosecutor’s Office said on Saturday it had received confirmation of the arrest of Muammar Gaddafi’s son, Saif al-Islam, from Libya’s Ministry of Justice.
“We are coordinating with the Libyan Ministry of Justice to ensure that any solution with regards to the arrest of Saif al-Islam is in accordance with the law,” ICC prosecution office spokeswoman Florence Olara said.
